We collect your personal data and information from you when you register (whether online or otherwise) as a purchaser, tenant or customer/prospective purchaser, tenant or customer or enter into any transaction with us. The personal data and information which we collect include your name, address, gender, age, identity card number, passport number, company registration number, marital status, income range, contact information, type of loans applied for in relation to the purchase of property; property for let etc (collectively “your personal data”).

If, in the course of transacting or communicating with us, you have provided or provide any personal data to us relating to another individual, you represent and warrant to us that: (i) you have provided a copy of our Personal Data Protection notice to each of such individual; (ii) you have obtained the consent in writing of each of such individual to the processing of their personal data by Kwong Hing; and (iii) you will provide us with a copy of such consent when so requested by us.

Your personal data will be collected, held on computer and/or in manual files, used, disclosed and otherwise processed by Kwong Hing to facilitate the performance and administration of our functions, including the following purposes:

to facilitate the submission of any relevant information or documents to the relevant local authority for property registration purposes and the transfer of property in favour of purchasers or registration of leases in favour of tenants;
to facilitate the execution of the relevant agreements and/or contracts for the purchase of property; property for let and/or other products and services from us;
for credit assessments and other background checks of purchasers, tenants or customers/prospective purchasers, tenants or customers as we may determine to be necessary or appropriate;
for the prevention of crime (including but not limited to fraud, money-laundering, bribery); for security and emergencies – to abate or prevent any crime / intrusion into demised premises;
for purposes of billing and collection of outstanding payments;
for contact purposes;
to respond to enquiries and provision of information on new housing/commercial developments/property for let,
for administrative purposes, including our internal record-keeping;
for the maintenance of purchaser, tenant or customer database and customer service related processes;
for purposes of compliance with any legal, regulatory and/or statutory requirements relating to the provision of our services and products and to make any disclosure as required pursuant to such legal, regulatory and/or statutory requirements;
for applying for, and /or maintaining, insurance policies for the building/premises and for any insurance claims purposes.
general operations and maintenance of the services provided or required under any law to be provided by us;
to regularize data held by us and our group of companies (if any) relating to purchasers, tenants or customers from time to time.

Your personal data is essential and important to us. If you do not provide or update all the information as requested, we will not be able to keep complete information about you, thus affecting our ability to fulfil the purposes stated above.

We may disclose and transfer your personal data to the following parties (whether within or outside Malaysia) for the purposes stated above:

property agents, contractors, sub-contractors and service providers providing services relating to property and for which your personal data is collected;
relevant Land Office/ relevant Land Registry for purposes of applying for consent to transfer, application for strata titles/individual titles and registration of the transfer in favour of purchasers, registration of lease in favour of tenants and such other relevant government agencies, semi government bodies, statutory authorities and industry regulators in relation to the property such as DBKL, MPPJ, Indah Water Konsortium Sdn Bhd etc;
panel solicitors who are preparing the sale and purchase agreements and transfer forms (Form 14A) to register property in favour of purchasers; appointed solicitors who are preparing the tenancy agreements in favour of tenants including lawyers who attend to matters relating to any breach or enforcement of contracts; to defend any rights or property of Kwong Hing, its personnel and its related and/or group of companies;
Treasury of Malaysia (Bahagian Pinjaman), banks and financial institutions for purposes of issuance of undertakings and processing of loan for the purchase of property and such other related purposes;
any person who has undertaken a duty of confidentiality to keep such data confidential; and
any law enforcement agency, courts of Malaysia or pursuant to any court order.

It is important that your personal data is kept up-to-date. Should there be any changes in your personal data, such as address, phone/fax number, email address and other personal identification or information, kindly update the same with us as soon as possible so that we may update our records.

In the event of any inconsistency or conflict between the English version and the Bahasa Malaysia version of this Personal Data Protection Notice, the English version shall prevail.

PENGGUNAAN DATA PERIBADI ANDA

Data peribadi anda akan diproses atau digunakan oleh Kwong Hing atau pihak-pihak yang diberi kuasa, bagi menyokong maksud-maksud yang dinyatakan pada masa di mana ia diberi atau diminta dan/atau sebab-sebab yang dibentangkan berikut. Untuk tujuan ini, kami komited dalam memastikan data peribadi dan maklumat anda akan diproses mengikut kehendak Akta Perlindungan Data Peribadi 2010 (“Akta”) dan polisi internal kami yang ketat.

Kami mengumpul data peribadi dan maklumat anda apabila anda mendaftarkan diri dengan kami sebagai pembeli, penyewa atau pelanggan kami/ bakal pembeli, penyewa atau pelanggan kami atau apabila anda memasukki sebarang transaki dengan kami. Data peribadi dan maklumat anda yang kami kumpulkan daripada anda adalah nama, alamat, jantina, umur, nombor kad pengenalan/pasport, nombor pendaftaran syarikat, status perkahwinan, pendapatan, maklumat hubungan, jenis pinjaman berkaitan dengan pembelian hartanah kami, hartanah untuk disewa dan sebagainya (kemudian ini dirujuk sebagai “Data Peribadi anda”)

Jika, semasa menjalankan atau berkomunikasi dengan kami, anda telah menyediakan atau memberikan apa-apa data peribadi kepada kami berhubung dengan individu yang lain, anda mewakili dan menjamin kepada kita bahawa: (i) anda telah memberikan satu salinan notis perlindungan Data Peribadi kami kepada setiap individu tersebut; (ii) anda telah memperolehi kebenaran bertulis setiap individu tersebut untuk pemprosesan data peribadi mereka oleh Kwong Hing; dan (iii) anda akan memberikan kami satu salinan persetujuan sedemikian apabila diminta oleh kami.

Data peribadi anda akan dikumpulkan dan disimpan di komputer dan/atau difailkan dalam fail fail, digunakan, dibekalkan ataupun diproses oleh Kwong Hing untuk memudahkan penyelenggaraan urusan urusan kami iaitu:-

Untuk memudahkan penyerahan apa-apa maklumat atau dokumen kepada pihak berkuasa tempatan yang berkaitan untuk tujuan pendaftaran harta dan pindah milik kepada pembeli atau pendaftaran pajakan atas nama penyewa;
Untuk memudahkan tandatangan perjanjian jualbeli ataupun kontrak untuk membeli hartanah, perjanjian sewa ataupun produk dan servis kami yang lain;
Untuk tujuan penilaian kredit dan semakan latar belakang yang lain pembeli, penyewa atau pelanggan/bakal pembeli penyewa atau pelanggan yang kami menentukan perlu atau sesuai;
untuk pencegahan jenayah (termasuk tetapi tidak terhad kepada penipuan, pengubahan wang haram, rasuah); untuk keselamatan dan kecemasan – untuk reda atau mengelakkan apa-apa jenayah / pencerobohan ke dalam premis tersebut premis;
untuk tujuan kewangan dan bil dan kutipan bayaran tertunggak
untuk menghubungi anda;
untuk membalas pertanyaan dan penyediaan maklumat mengenai pembangunan perumahan/komersial baru/hartanah untuk disewa,
Bagi urusan-urusan pentadbiran termasuk rekod dalaman kami;
untuk penyenggaraan pangkalan data pembeli, penyewa atau pelanggan dan proses-proses yang berkaitan dengan perkhidmatan pelanggan dan
untuk memenuhi keperluan undang-undang dan badan-badan berkanun;
untuk tujuan tuntutan insurans
bagi tujuan operasi dan penyenggaraan perkhidmatan yang disediakan oleh kami secara umum.
untuk kemaskini data yang dipegang oleh kami dan kumpulan syarikat kami (jika ada) yang berkaitan dengan pembeli, penyewa atau pelanggan dari masa ke semasa.

Data dan maklumat peribadi anda amat mustahak kepada kami. Jikalau anda gagal membekal ataupun kemaskini data peribadi anda dengan kami, kami tidak dapat memproses dan/atau menzahirkan data peribadi anda bagi mana-mana tujuan tersebut di atas.

Kami mungkin mendedahkan atau memindah data peribadi tersebut kepada pihak-pihak berikut (sama ada di dalam atau di luar negara) bagi tujuan seperti yang dinyatakan diatas:

ejen-ejen •hartanah, kontraktor, sub-kontraktor dan pembekal yang menyediakan perkhidmatan berkaitan kepada harta dan bagi yang data peribadi anda dikumpul;pihak ketiga (termasuk yang berada di luar negara) yang menyediakan perkhidmatan pemprosesan data kepada kami;
Pejabat Tanah berkenaan / berkaitan dengan permohonan kebenaran untuk pemindahan, permohonan hak milik strata geran/individu dan pendaftaran pemindahan kepada pembeli, pendaftaran pajakan atas nama penyewa dan apa-apa lain-lain agensi-agensi kerajaan yang berkaitan, badan-badan separuh kerajaan, badan berkanun dan pengawal-selia industri berkaitan harta tanah seperti DBKL, MPPJ, Indah air Konsortium Sdn Bhd dll;
panel peguam yang akan menyediakan perjanjian jualan dan pembelian dan borang-borang (Borang 14A) pindah milik untuk mendaftarkan pindahmilik hartanah kepada pembeli; peguam cara yang dilantik yang akan menyediakan perjanjian sewa kepada penyewa-penyewa yang termasuk peguam yang menguruskan hal-hal yang berhubungan dengan apa-apa pelanggaran atau penguatkuasaan kontrak untuk mempertahankan apa-apa hak atau harta Kwong Hing, kakitangan dan syarikat berkaitan;
mana-mana individu yang dibawah kewajipan kerahsiaan yang telah mengaku janji untuk memastikan data tersebut dirahsiakan; dan
sebarang agensi penguatkuasa, mahkamah mahkamah Malaysia atau menurut perintah mahkamah.

Adalah amat mustahak data peribadi anda dikemaskinikan. Jikalau ada sebarang perubahan data peribadi anda seperti alamat, nombor telefon/faks, alamat e-mel, dan segala maklumat peribadi, sila bekalkan kami maklumat tersebut secepat mungkin.

memberitahu yang anda ingin kami berhenti memproses data peribadi anda atau tidak lagi bersetuju dengan kami memegang, menyimpan atau mengekalkan data peribadi anda. Walaubagaimanapun, sila ambil perhatian bahawa ini mungkin menyebabkan kami tidak dapat melaksanakan atau menunaikan tanggungjawab kami kepada anda; atau
